It is important to appeal within 30 days of the Magistrates' Court decision. Carroll v Browne [2018] VSC 253 is a case in which the Supreme Court made clear that parliament has deliberately chosen to restrict appeals to within 30 days of the decision subject to appeal. This is different to criminal appeals which allow a party to seek leave to appeal out of time in certain circumstances. There is no leave to appeal out of time in relation to intervention order matters to the County Court.
